CVS Health, UnitedHealth Group and Cigna have asked U.S. Federal Trade Commission chair Lina Khan and commissioners Rebecca Kelly Slaughter and Alvaro Bedoya to disqualify themselves from an FTC lawsuit that has accused the companies of unlawfully inflating insulin prices.

The FTC has filed a formal complaint accusing CVS, Cigna, and UnitedHealth of engaging in anti-competitive practices that inflate insulin prices. The complaint claims the PBMs' focus on rebates raises patient costs.

CVS Health and UnitedHealth Group have asked U.S. Federal Trade Commission chair Lina Khan and commissioners Rebecca Kelly Slaughter and Alvaro Bedoya to disqualify themselves from an FTC lawsuit that has accused the companies of unlawfully inflating insulin prices.

Attorneys argue Khan and two other commissioners are biased against pharmacy benefit managers and should recuse themselves from an ongoing lawsuit against the middlemen.

Cigna said that Khan, along with Commissioners Rebecca Kelly Slaughter and Alvaro Bedoya, have made repeated and incorrect prejudgments that show bias against pharmacy-benefit managers.

CVS (CVS) and UnitedHealth Group (UNH) on Tuesday demanded that Federal Trade Commission (FTC) Chair Lina Khan and two other commissioners recuse themselves from the agency’s lawsuit against the companies,

The companies argue the commissioners have "a lengthy track record of making public statements that indicate serious bias" against pharmacy benefit managers.
